This form must be signed and on file for every owner whose horses are entered in the Peruvian Futurity! It must accompany all applications for entry into the Futurity.

Conditions of Entry

Every entry in the Futurity shall constitute an agreement and affirmation that all participants (which include without limitation, the owner, lessee, trainer, manager, agent, rider, handler and the horse), for themselves, their principals, representatives, employees and agents and heirs:

1. Shall be subject to the rules and regulations of the Peruvian Futurity and the PPHRNA.
2. Represent that every horse, rider, and handler is eligible as entered.
3. Agree to be bound by the Rules of the Peruvian Futurity and the PPHRNA, and agree to hold the competition, the Peruvian Futurity, the PPHRNA, their officials, directors, and employees harmless for any action taken. This shall be a condition of entry.
4. Agree that as a condition of and in consideration of acceptance of entry, entrant authorizes the Peruvian Futurity to market, transfer, assign, or otherwise make use of any photographs, likenesses, films, broadcasts, cable casts, audiotapes, or videotapes taken of the horse(s) and participants while on the grounds, incident to, or in transit between the stabling facility and the event site, in any way they see fit for the promotion, coverage or benefit of the event, sport or the Peruvian Futurity, without compensation to any of them so long as the use neither jeopardizes amateur status nor endorses specific products or services, and hereby expressly and irrevocably waive and release any rights in connection with such use, including any claim to invasion of privacy, right of publicity, or to misappropriation. This shall be a condition of entry.
5. Agree that they participate voluntarily in the competition fully aware that horse sports and the competition involve inherent dangerous risk of serious injury or death, and by participating they expressly assume any and all risks of injury or loss, and they agree to indemnify and hold the Peruvian Futurity, the PPHRNA, and their officials, directors, employees and agents harmless from and against all claims including for any injury or loss suffered during or in connection with the competition, whether or not such claim, injury or loss resulted, directly or indirectly, from the negligent acts or omissions of said officials, directors, employees, or agents of the Peruvian Futurity, PPHRNA or competition. This shall be a condition of entry.
6. The Peruvian Futurity and the PPHRNA, the Show Committee and Officials, Horse Show Management and its employees will, in no way, be responsible for any accident or loss of life or limb which may occur to rider, owner, trainer, agent, groom, spectator, attendant or animal at its shows. Nor will the above be responsible for loss or destruction of any property or equipment or damages to or by any animal on exhibition at the show grounds or stabling area. This shall be a condition of entry.
7. It is understood that anyone who does not abide by the above conditions of entry, or in anyway does anything cruel, abusive or illegal to a horse, shall be forever banned from the Peruvian Futurity without recourse.
8. ALL DISPUTES ARE SUBJECT TO ARBITRATION: All claims and disputes arising out of this contract shall be submitted to, and shall be determined by, binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA), and judgement on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction, Such arbitration shall be subject to the Federal Arbitration Act (9U.S.C.§1, et. seq.) Any questions not resolved under these rules shall be resolved by Texas Law. Arbitration shall be held in Fort Worth, Texas at a location determined by the AA. The prevailing party in any dispute shall recover his/her attorneys fees, costs and expert’s fees. This is a condition of entry.
Video Reviews: Videos will not be reviewed by judges, show management, stewards, or the Futurity Hearing Committee concerning class placings or for any other purpose. All Decisions of officials are final.
Drugs and Medications: The Peruvian Futurity is a Drug Free Show. Any horse exhibited at the Futurity that receives any medication which contains a forbidden substance shall not be eligible for competition. Both urine and blood testing will be used to detect the presences drugs. The entry of any horse into the Futurity automatically gives the owner’s consent to drug testing of that horse.
I have read the Peruvian Futurity Rules and Regulations, the PPHRNA Show Rules and the Conditions of Entry and agree to abide by them. This agreement binds my heirs, trainer, manager, agent, rider, handler, lessee, horse and anyone affiliated with the ownership or management of the horse, to the above conditions and rules. I agree to the drug testing procedures used by the Peruvian Futurity and agree to abide by the findings.
